Motion 312

That a special committee of the House be appointed and directed to review the declaration in Subsection 223(1) of the Criminal Code of Canada which states that a child becomes a human being only at the moment of complete birth and to answer the questions hereinafter set forth;
 
that the membership of the special committee consist of twelve members which shall include seven members from the government party, four members from the Official Opposition and one member from the Liberal Party, provided that the Chair shall be from the government party; that the members to serve on the said committee be appointed by the Standing Committee on Procedure and House Affairs and the membership report of the special committee be presented to the House no later than 20 sitting days after the adoption of this motion;
 
that substitutions to the membership of the special committee be allowed, if required, in the manner provided by Standing Order 114(2);
 
that the special committee have all the powers of a Standing Committee as provided in the Standing Orders; and
 
that the special committee present its final report to the House of Commons within 10 months after the adoption of this motion with answers to the following questions,
 
      (i)            what medical evidence exists to demonstrate that a child is or is not a human being before the moment of complete birth?,
 
   (ii)            is the preponderance of medical evidence consistent with the declaration in Subsection 223(1) that a child is only a human being at the moment of complete birth?,
 
 (iii)            what are the legal impact and consequences of Subsection 223(1) on the fundamental human rights of a child before the moment of complete birth?,
 
 (iv)            what are the options available to Parliament in the exercise of its legislative authority in accordance with the Constitution and decisions of the Supreme Court of Canada to affirm, amend, or replace Subsection 223(1)?

Qu’un comité spécial de la Chambre soit nommé et chargé d’examiner la déclaration figurant au paragraphe 223(1) du Code criminel, selon laquelle un enfant devient un être humain seulement lorsqu’il est complètement sorti du sein de sa mère, et de répondre aux questions énoncées ci-après :

que le comité spécial se compose de 12 membres, dont sept provenant du parti au pouvoir, quatre de l’Opposition officielle et un du Parti libéral, attendu que son président soit du parti au pouvoir; que les membres du comité spécial soient nommés par le Comité permanent de la procédure et des affaires de la Chambre et que le rapport sur la composition du comité spécial soit présenté à la Chambre au plus tard 20 jours de séance après l’adoption de la motion;

que l’on autorise les substitutions dans la composition du comité spécial, au besoin, de la façon prescrite au paragraphe 114(2) du Règlement;

que le comité spécial dispose de tous les pouvoirs conférés à un comité permanent en vertu du Règlement et

que le comité spécial présente à la Chambre des communes, dans les 10 mois suivant l’adoption de la motion, son rapport final comprenant les réponses aux questions suivantes :

(i) quelles preuves médicales existe-t-il démontrant qu’un enfant est ou n’est pas un être humain avant le moment où il a complètement vu le jour?

(ii) la prépondérance de la preuve médicale concorde-t-elle avec la déclaration figurant au paragraphe 223(1) du Code criminel, selon laquelle un enfant est un être humain seulement lorsqu’il est complètement sorti du sein de sa mère?

(iii) quel est l’impact juridique et quelles sont les conséquences du paragraphe 223(1) sur les droits de la personne fondamentaux d’un enfant avant le moment où il a complètement vu le jour?

(v) de quelles options le Parlement dispose-t-il en ce qui concerne l’exercice de son pouvoir législatif conformément à la Constitution et aux décisions de la Cour suprême du Canada pour affirmer, modifier ou remplacer le paragraphe 223(1)?
